We understand that privacy and the security of your personal information is extremely important. This policy sets out what we do with your information and what we do to keep it secure. It also explains where and how we collect your personal information, as well as your rights over any personal information we hold about you. This Policy explains how we do this and tells you about your privacy rights and how the law protects you.
INTRODUCTION
Heather Alaine, LLC (“Heather Alaine,” “we,” “us,” or “our”), a California limited liability company, respects your privacy and is committed to protecting the personal information of visitors, members, students, and clients who interact with our website, currently hosted on the Zenler platform (the “Site”), and our related coaching, movement, and retreat services (collectively, the “Services”).
This Privacy Policy explains what personal information we collect, why we collect it, how we use and share it, and the rights available to you under California and United States law. This Policy applies to your use of the Site and to other interactions you have with us, such as creating an account, purchasing or signing up for a program or membership, subscribing to our newsletter, opening a support request, or contacting us by email or social media. If you do not agree with this Policy, please do not access or use the Site.

THE ZENLER PLATFORM
Our Site and Services are hosted and delivered through Zenler (New Zenler), a third-party online course and membership platform. With respect to personal information you submit through the Site — including your account information, purchases, and any content or communications you provide as a student or client (“Student Data”) — Heather Alaine, LLC is the data controller/business, and Zenler acts as our data processor/service provider, handling that information solely on our behalf and instruction, subject to a data processing agreement between us. Zenler is not itself the provider of our coaching, movement, or wellness services. If you have questions about how your information is handled on the Site, please contact us directly using the information below rather than Zenler.
WHAT PERSONAL INFORMATION WE COLLECT
We may collect the following categories of personal information:
Communication Data — any communication you send us, whether through a contact form, email, text, or social media messaging.
Customer Data — information related to your purchases, such as your name, billing and delivery address, email address, phone number, and payment details (processed through our payment providers; we do not store full payment card numbers ourselves).
User Data — information about how you use the Site and any content you post, upload, or create, such as forum posts, survey responses, or program materials. Technical Data — information such as your IP address, browser and device type, login data, time zone, page views, and navigation paths, collected automatically through our analytics tools.
Marketing Data — your preferences regarding marketing communications from us and your communication choices.
We do not intentionally collect Sensitive Personal Information as defined under the California Consumer Privacy Act (“CCPA”), such as government identification numbers, precise geolocation, racial or ethnic origin, religious beliefs, health information, sexual orientation, or genetic or biometric data used for identification purposes.
HOW WE COLLECT INFORMATION
We collect personal information in the following ways:
● Directly from you, such as when you fill out a form on the Site, purchase a program or membership, or send us an email.
● Automatically, as you use the Site, through cookies and similar tracking technologies. See the “Cookies and Tracking Technologies” section below.
● From third parties, such as analytics providers, advertising networks, and payment processors, as described below.
THIRD-PARTY SERVICES AND INTEGRATIONS
We use the following categories of third-party services in connection with the Site. When a third-party service is enabled, it may collect or receive personal information in accordance with our agreement with that provider. We do not receive or store your passwords for these third-party services.
● Zenler.com — online course and membership platform (data processor/service provider)
● Stripe — payment processing
● Zoom — live class and coaching delivery
● Vimeo — video hosting
● Amazon Web Services — cloud infrastructure, email delivery, and file storage
We do not currently run advertising or marketing tracking campaigns, and we have not installed third-party analytics or advertising tracking codes — such as Google Analytics or a Meta/Facebook Pixel — on the Site. If this changes in the future, we will update this Policy and our Cookie Policy accordingly, along with your associated opt-out rights described below.
MALWARE/SPYWARE/VIRUSES:
Neither the Company nor the Site knowingly permit the use of malware, spyware, viruses, and/or other similar types of software. Links to External Sites: The Company is not responsible for the content or practices of third party websites that may be linked to the Site. The Company is also not responsible for any information that you might share with such linked websites. You should refer to each website’s respective privacy policy and practices prior to disclosing any information.
BULLETIN BOARDS AND CHAT AREAS: Guests of the Site are solely responsible for the content of messages they post on the Company’s forums, such as chat rooms and bulletin boards. Users should be aware that when they voluntarily disclose personal information (e.g., user name, e-mail address, phone number) on the bulletin boards or in the chat areas, that information can be collected and used by others and may result in unsolicited messages from other people. You are responsible for the personal information you choose to submit in these instances. Please take care when using these features.
CHOICE/OPT-OUT: The Site may provide you the opportunity to opt-in to receive communications from us at the point where we request information about you. You always have the option of removing your name from any e-mail list in order to discontinue any such future communications. In order to ensure immediate removal from any list, please follow the specific instructions set forth within the communications you receive from the Company which you no longer wish to receive. If you are unsuccessful in completing the instructions specified in any such communication, please send an e-mail to hellaloveandgratitude@gmail.com including a copy of the undesired email attached to the request, and state you wish to be removed from the mailing list.
TRANSFER OF INFORMATION ACROSS NATIONAL BORDERS: Our site and various information we collect are operated on servers located in various jurisdictions, including the United States. When you access or use the Site and/or our services, personal information about you may be transferred outside the country in which you are situated to these other locations. The Company’s policies ensure that such personal information is protected to the same standard when processed by any Company entity or office around the world. We also ensure that appropriate contracts containing standard data protection clauses approved by the European Commission to protect that information and the rights of individuals are in place with any and all third-party service providers we may use.
HOW WE USE YOUR PERSONAL INFORMATION
We use your personal information for the following purposes:
● To provide and deliver the Services you have purchased or signed up for, and to maintain records of those transactions.
● To operate, secure, and improve the Site, including maintaining backups and administering user accounts.
● To communicate with you, respond to inquiries, and provide customer support.
● To send you marketing communications, where you have consented or where permitted by law, and to allow you to participate in promotions.
● To analyze use of the Site and measure the effectiveness of our advertising.
● To comply with our legal and tax obligations, and to establish, exercise, or defend legal claims.
DISCLOSURE OF YOUR PERSONAL INFORMATION
We do not sell your personal information for money. We may disclose personal information to the categories of recipients below, each of which is required to protect your information and use it only for the purposes we authorize:
● Zenler, as our data processor/service provider for the Site.
● Service providers who support our cloud infrastructure, video hosting, live class delivery, email delivery, and payment processing (see “Third-Party Services and Integrations” above).
● Professional advisors, including our attorneys, accountants, and insurers.
● Government or regulatory bodies, where required by law.
● A successor entity, in the event of a sale, merger, or transfer of all or part of our business.
DATA SECURITY
We have implemented reasonable technical, administrative, and physical security measures designed to protect your personal information from unauthorized access, use, alteration, or disclosure. We limit access to personal information to those who have a legitimate business need for it. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
DATA RETENTION
We retain personal information only as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, and tax reporting requirements. For example, California and federal tax law generally require us to retain basic customer transaction records for at least six years. We may retain and use anonymized or aggregated data indefinitely for research or analytical purposes.
Your Access to and Control Over Your Personally Identifiable Information:
At any time, but only once per calendar year, or as otherwise required under applicable law, users may contact Company to review the personally identifiable information that Company has collected about you. If you discover any errors, please notify Company and the information will be corrected. To review the personally identifiable information that company has collected about you, please send an email to hellaloveandgratitude@gmail.com with the subject line: “Personal Information Review Request.” Users may also request that Company delete a user account(s) or, if you have not established a user account, your email address, and any related data at any time. If you wish to delete your user account(s), please send an email to hellaloveandgratitude@gmail.com with the words “Delete Account” in the subject line. If you do not have a user account and wish to delete your email address or other personally identifiable information that you might have provided through your use of the Site, any Games, and/or any Services, please send an email to hellaloveandgratitude@gmail.com with the words “Delete My Information” in the subject line. You may also choose to confirm that the Company does not use your personal information in certain ways and/or to otherwise “opt out” of certain uses of that personal information, including without limitation (i) when your personal may to be disclosed to a third party unrelated to the Company and/or parties directly related to providing your Services and/or (ii) when your personal information may be used for a purpose that is materially different from the purpose(s) for which it was originally collected or subsequently authorized by you. If you wish to limit your personal data in either such way, or have other questions about how the Company may use your personal data, please send an email to hellaloveandgratitude@gmail.com with the words “Privacy Request” in the subject line.
YOUR CALIFORNIA PRIVACY RIGHTS
If you are a California resident, the CCPA, as amended by the California Privacy Rights Act, gives you the following rights with respect to your personal information:
● Right to Know — the right to request disclosure of the categories and specific pieces of personal information we have collected about you, and the categories of sources, purposes, and third parties involved.
● Right to Delete — the right to request deletion of personal information we have collected from you, subject to certain legal exceptions.
● Right to Correct — the right to request correction of inaccurate personal information we maintain about you.
● Right to Opt Out of Sale or Sharing — we do not sell personal information for money and do not currently use advertising or cross-context tracking tools (such as a Meta/Facebook Pixel) that would constitute “sharing” under the CCPA. If this changes in the future, we will update this Policy and provide a mechanism to opt out. ● Right to Opt Out of Automated Decision-Making Technology — we do not currently use your personal information for automated decision-making or profiling that produces legal or similarly significant effects.
● Right to Limit Use of Sensitive Personal Information — as noted above, we do not intentionally collect Sensitive Personal Information.
● Right to Non-Discrimination — we will not discriminate against you, deny you services, or charge you a different price for exercising any of these rights.
To exercise any of these rights, please contact us using the information in the “How to Contact Us” section below. We will need to verify your identity before processing certain requests. We will respond to verifiable requests within the time required by law, generally within 45 days.
OTHER LEGAL RIGHTS
Depending on your location, you may also have the right to request access to, correction of, or erasure of your personal data; to object to or restrict certain processing; and to request portability of your data. COOKIES AND TRACKING TECHNOLOGIES
The Site uses session-based and persistent cookies set by our course platform provider, Zenler, to operate core site functions such as keeping you logged in, remembering your cart, and processing checkout. We do not currently run advertising or marketing campaigns and have not installed third-party analytics tracking codes, such as Google Analytics, on the Site. Because we do not use advertising or cross-context tracking cookies, we do not currently respond to browser “Do Not Track” or Global Privacy Control (“GPC”) signals; if our use of cookies changes in the future, this Policy and our Cookie Policy will be updated accordingly. You can set your browser to refuse some or all cookies, or to alert you when a cookie is set; if you disable cookies, some parts of the Site may not function properly. CHILDREN'S PRIVACY
The Site is not directed to children, and by providing us with information, you represent that you are at least 18 years of age, consistent with our Terms & Conditions. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without parental consent, we will delete it. If you believe a child has provided us with personal information, please contact us using the information below. THIRD-PARTY LINKS The Site may contain links to third-party websites or services. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policy of any website you visit.
INTERNATIONAL VISITORS
Heather Alaine, LLC is based in the United States, and the Site is hosted on servers that may be located in the United States and other jurisdictions. If you access the Site from outside the United States, your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those of your home jurisdiction.
CHANGES TO THIS POLICY
We may update this Privacy Policy from time to time. If we make material changes, we will update the effective date above and, where required by law, provide additional notice. Your continued use of the Site after any changes constitutes your acceptance of the updated Policy.
